  • Requiring work to be done before or after the paid shift. This includes things like…
    • Logging into computer systems before the start of the paid shift;
    • Putting on or taking off protective safety equipment outside the paid shift;
    • Washing tools or work areas after the paid shift;
    • Completing paperwork or other types of reports after the paid shift ends.
  • Refusing to pay for overtime that was actually worked, but that the manager did not “pre-approve.” Pre-approval is not required for work to be legally compensable.
  • Defining certain types of tasks as “not work” and not paying for them. The law, not your employer, dictates what is “work.” If the task is necessary to the job, it is probably “work.”
  • Requiring people to report to work, but making them wait to “clock in” until the store gets busy.
  • Misclassifying workers as “exempt” from overtime laws. There are strict laws about who is truly “exempt” from overtime, and being paida “salary” or being called a “manager” is not enough.
  • Treating workers as “independent contractors” instead of “employees.” If the company controls your schedule or manner of work, you may be an “employee” protected by wage laws.
  • Sending workers home immediately when they arrive at work, and not paying for any time at all.
  • Giving workers “rest” breaks without pay.
  • Automatically deducting time for lunch or other meal breaks, even if the break is not taken.
  • Illegally deducting workers’ wages for work tools or uniforms or cash drawer shortages. If the deductions result in the worker receiving less than the minimum wage, it is illegal. Some states also specifically restrict deductions from wages.
  • Paying employees who receive tips an hourly rate that, combined with tips, does not meet the minimum wage.
  • Refusing to pay for training that is specific to the employer.
